Such was the case in June 2012 when 18-year old Brittany Walsh died as a result of a Long Island drunk driver?s reckless actions. Brittany had attended her prom a few days earlier and a graduation party the night before her death. On a Sunday, while returning from her part-time job, a drunk driver ran two red lights while traveling at 100 miles per hour and struck her car without even attempting to brake.
Prior to the accident, a fast food restaurant bystander had noticed that Michael Grasing, age 31, was intoxicated and advised him not to drive. A police officer witnessed him driving 100 mph moments before he crashed. His blood alcohol content tested at four times the legal limit. Among a long list of charges that included reckless endangerment, reckless driving, manslaughter, leaving the scene, and aggravated DWI as a felony and misdemeanor, authorities also charged him with aggravated vehicular homicide. A murder conviction could result in a 25-years prison sentence.
While the family feels consoled by the fact prosecutors are seeking murder charges, they lament that nothing can bring their daughter back. To receive compensation for damages, the family will have to pursue a civil wrongful death case.
